CONSTITUTION OF THE ASSOCIATED STUDENTS

ARTICLE I – NAME

The name of this organization shall be the Associated Students of Golden West College.

ARTICLE II – OBJECT

The object of the Associated Students is to assure effective student participation in all appropriate areas of student life through independent action, and in concert with other constituencies of the college community, participate in the formation and the improvement of educational programs, protect full freedom of assembly and expression in the college community, articulate and represent the student interest in the operation of the campus, provide services and coordinate activities for the students, and advance the common interest and concerns of students.

ARTICLE III – MEMBERSHIP

All students currently enrolled in Golden West College are members of this organization.

ARTICLE IV – PRESIDING BODY

Section 1.

The presiding body of the Associated Students of Golden West College shall be the Student Council.

Section 2.

The majority of the Student Council members currently holding office shall constitute a quorum. No business may be conducted by the Student Council without presence of a quorum.

Section 3.

All members of the Student Council must be enrolled in at least five units of work at Golden West College throughout their term in office. All members must also complete five units with at least a 2.2 GPA each semester while in office.

Section 4.

The voting members of the Student Council shall be: President, Vice-President, Club Consultant, Student Advocate, Finance Commissioner, Activities Commissioner, Public Relations Officer, and Sustainability Commissioner.

ARTICLE V – OFFICERS

Section 1.

The President and Vice-President shall have completed 12 units of work on the Golden West College campus with a cumulative GPA of at least 2.5 at the time of their election.

Section 2.

The Student Advocate, Public Relations Officer, Finance Commissioner, Club Consultant, Activities Commissioner and Sustainability Commissioner shall not have less than a cumulative 2.5 GPA in all college work completed at the time of election.

Section 3.

All officers shall be elected from the student body at large for a term of one year as specified in the ASGWC Standing Rules.

Section 4.

All Student Council members’ duties shall be described in the ASGWC Standing Rules.

Section 5.

Elective positions on the Student Council that were not filled in the general election will be filled by special election or by presidential appointment at the option of the President, subject to the ASGWC Standing Rules.

Section 6.

The President shall, when appointing persons to fill offices, present candidates for those seats to the Student Council for ratification within thirty days of vacancy. Candidates for appointment shall meet all requirements for election to the office sought.

Section 7.

If the office of the President shall be vacant, the Vice-President shall assume the office of the Presidency.

Section 8.

If the office of the Vice-President is vacated, the Student Council shall elect a new Vice-President from the existing members of the Student Council.

Section 9.

If all elected offices are vacated, the Golden West College Student Activities Director on behalf of the Student Council shall, within thirty days, hold a general election to fill such offices for the balance of the term of office of the previous incumbents.

ARTICLE VI – STUDENT SENATE

Section 1.

There shall be a Student Senate consisting of the ASGWC Vice-President as the chair, and various committees, as decided by the Student Council, in accordance to the ASGWC Standing Rules.

Section 2.

All members of the Student Senate shall have full voting privileges with the exception of the ASGWC Vice- President who may only vote in the case of a tie.

ARTICLE VII – INTER-CLUB COUNCIL

Section 1.

A representative body to the Student Council for all clubs shall be established with the name of Inter-Club Council.

Section 2.

The ICC shall operate under authority and powers granted by the ASGWC Standing Rules.

Section 3.

Each club shall have one vote on ICC.

ARTICLE VIII – COMMISSIONS

Section 1.

The Student Council may appoint commissions to assist in various functions of student government as the need arises.

Section 2.

The Student Council shall set the governance rules for the commissions when established.

ARTICLE IX – AMENDMENTS OF STANDING RULES

Section 1.

The Student Council shall have the authority to determine standing rules.

Section 2.

It shall require a four-fifths affirmative vote of the Student Council to pass, revise or rescind the Standing Rules after being published to the Student Body at large for a period of five school days.

ARTICLE X – IMPEACHMENT

Section 1.

A vote of impeachment can be called by either a petition signed by at least 1% of the Golden West College student body at the fourth week of enrollment or a simple majority of the Student Council.

Section 2.

Student Council members may be impeached by a vote from 1% of the Golden West College student body at the fourth week of enrollment, with at least two-thirds voting to impeach.

ARTICLE XI – CONSTITUTIONAL PRIORITY

The constitution is the governing document over all Associated Students affairs. In the event of any inconsistency, the Constitution takes precedence over any other Associated Students documents, including the ASGWC Standing Rules.

ARTICLE XII – AMENDMENTS TO THE CONSTITUTION

The constitution may be amended by a simple majority of those voting in a campus-wide general election, providing that the amendment was approved by a majority vote of the Student Council or that 5% of the fourth week enrollment of the Golden West College student body sign a petition requesting amending.

In extreme cases due to changes in the California Education Code, or District Policy the ASGWC Student Council has the right to make amendments to the Constitution providing a reasonable amount of time is given for public notification no less than five school days, and with four-fifths affirmative vote of the Student Council.
